KCA, Helped Consumers to Collectively Get Compensation

for Delayed Flight Case

- Supported 137 Low Cost Carrier passengers to file a lawsuit -

    Korea Consumer Agency (http://www.kca.go.kr) helped consumers to file a lawsuit against Low Cost Carrier for over 30hours of delay, and this led to the court’s ruling of compensation.

    Consumer Dispute Settlement Commission(CDSC) ruled that the airline company should make compensation due to delay, but the company refused to follow the decision. To this response, KCA decided to support 137 passengers filing a lawsuit, that KCA separately filed a lawsuit in January for passengers who took the first delayed plane and for the passengers who took the next plane lawsuit was filed in February.

    The court concluded that on Oct 7 2016, airline companies should “express regrets for inconvenience that plaintiff went through” and required the company to pay 150,000Won, and 100,000Won depending on damages and such a decision was made in Nov 2, 2016.

    KCA, supported consumers to win the case where consumers cancel e-ticket two days right after the purchase and request and achieved victory of all cases as of Oct 14. However, regarding this case Consumer Dispute Settlement Commission requested to request to refund the total amount of deposit according to retract offer right of 「Act on The Consumer Protection in Electronic Commerce, etc.」, plane companies refused to pay consumers citing cancellation fee conditions.

    KCA will also make efforts to protect consumer rights and redress through consumer support system that is in line with the public benefits in future cases that has huge social and economic influences and repeatedly occur with businesses that do not accept the ruling.
