The Consumer Dispute Settlement Commission (President Kim, Hak-geun) on Nov. 23rd, 2009 commenced the Collective Alternative Dispute Resolution against SM Entertainment and Dream Maker for cancellation of a [SM TOWN Live ‘09] concert. The Collective ADR was requested by 623 fans of SM Entertainment singers including TVXQ, Super Junior, GIRL’S GENERATION, and SHINEE as they demanded compensation for material and emotional damage by the concert cancellation.
The case is focused as the Commission will determine whether to bring contractors to account for the past practice of contractors who cancelled or failed to hold a concert and gave a refund only for the admission fee after having postponed the concert unilaterally.
As the collective ADR procedure is determined to be initiated, the Commission is slated to receive registration from consumers, who were identically damaged from the same contractors, from Nov. 25th to Dec. 9th, 2009. Consumers who want to apply for the ADR procedure can register at the Korea Consumer Agency website (www.kca.go.kr) – Consumer Counseling (Sang-dam-ma-dang) – collective ADR registration/ reference.
Applicants must be ones who purchased the concert ticket from G-market (www.gmarket.co.kr) or Dream Maker Entercom (www.dment.co.kr). In case the applicant is a minor, the minor’s parents should act as a legal representative for the minor to apply for the collective ADR procedure.
