The Commencement of the Collective Alternative Dispute Resolution procedure over the issue of Hana TV’s charging fees for servicing MBC TV contents
1. Case Summary
On March 24, 2008, according to the Framework Act on Consumer (Article 68), the Consumer Dispute Settlement Commission (CDSC/Chair: Kou-Whan Jeong) has decided to commence the Collective Alternative Dispute Resolution procedure regarding the claims raised by the Hana TV subscribers against Hana TV’s charging fees for servicing MBC TV contents.

3. Consumers’ Claims
Having launched Hana TV business based on high speed internet service from July 2006, the Hanaro Telecom Co. committed to the Hana TV subscribers to provide terrestrial TV content services (MBC, KBS, SBS) at free of charge after a 12 hour holdback period.
However, the conflict between Hana TV & its subscribers occurred on January 15, 2008 because Hana TV began to require charges of 500 won per MBC content when viewing before the seven-day holdback period.

Provide MBC TV contents at free of charge (Execution of the original contract terms and conditions)

6. This case will examine thoroughly the supplier’s liability on unilateral modification of the business terms and conditions such as service changes or the addition of extra charges without the customers’ prior consent. |
